The Freedom of Information and Protection of Privacy Act gives the public a right to access District records with limited exceptions while protecting personal privacy and regulates how the District of Kent (the “District”) collects, uses and discloses personal information in fulfilling its statutory responsibilities and operating its programs.
Routine Requests |
Routine information such as agendas, minutes, bylaws, policies, procedures and information related to your property are available without submitting a formal request. To request and obtain copies of records of a non-personal nature, the Freedom of Information and Protection of Privacy Act (FOIPPA) dictates what can, and cannot, be released. |
Formal Freedom of Information (FOI) Requests |
A General FOI is intended to provide access to records rather than answers to specific questions or general information.
If the information you are seeking is not available through routine channels, a formal request must be submitted in writing in person, by mail, email, or fax to: Information and Privacy Coordinator 7170 Cheam Avenue PO Box 70 Agassiz, BC V0M 1A0 Fax: 604-796-9854 |
Fees |
Fees may be applied for processing FOI requests pursuant to section 75 of the Freedom of Information and Privacy Protection Act. Applicants will be provided with a cost estimate prior to releasing information. There are no application fees or processing fees for personal FOI requests. Application Fees: A non-refundable application fee of $10 is required for all General FOI requests. Your request will not be processed until payment is received. Fee payments are accepted 8:30 AM to 4:30 PM Monday to Friday, excluding statutory holidays, by phone at 604-796-2235. All major credit cards are accepted. Section 75 of the Freedom of Information and Protection of Privacy Act outlines the processing fees that can be charged for non-person FOI requests for the following tasks or services:
|
Can you email my copies of records when they are ready? |
Personal records are not sent by email for security reasons, to ensure that unauthorized persons cannot access your personal information. We can arrange for you to pick up your records in person, where you will need to show identification before receiving them. If you need your records urgently, you can arrange for a courier to pick them up and deliver them to you at your expense. |
What if I disagree with the response? |
If you have questions about the response you received, including the District's decision to withhold information, please contact the Information and Privacy Coordinator who processed your request. If the coordinator is unable to address your concerns, you may request a review by the Office of the Information and Privacy Commissioner (OIPC) within 30 business days of receiving the IAO response letter to your FOI request. |
Can I get a refund on my FOI application fee? |
There will be no refunds if no records were found or if you are unsatisfied with the records that you receive as a response to your request. Your application fee is for the administrative work required to initiate your request, and not for the records themselves. |
